RESOLUTION NO.
92-05
A RESOLUTION OF THE
WHEREAS, the West Mifflin Sanitary
Sewer Municipal Authority (Authority) enacted Resolution No. 1-96, which authorized
payment of various connection and tap-in fees;
and
WHEREAS, the Authority had authorized
he preparation of an Act 203 of 1990 study that formed the basis of the tap in
fees enacted by the Authority in Resolution No. 13-97;
WHEREAS, the Authority added
provisions regarding tap-in approval and fee payment in Resolution 14-97; and
WHEREAS, the Pennsylvania Legislature
enacted and the Governor signed Act 57 of 2003 which amended Act 203
of1990. Act 57 now governs the
calculation of tap-in fees; and
WHEREAS, the Authority has authorized
the preparation of an Act 57 of 2003 study; and
WHEREAS, the Authority deems it
necessary to amend said Resolution No. 13-97 to comply with Act 57of 2003; and
NOW, THEREFORE, be it resolved and it is
hereby resolved as follows:
FIRST: The Authority Board hereby acknowledges receipt
of the Act 57 study, which has been conducted pursuant to Act 57 of 2003.
SECOND: The Authority hereby acknowledges that the
total authorized tap-in-fee is $2,868.00 per EDU consisting of $1,588.00 for
the collection portion of this tap-in-fee and $1,280.00 for the capacity
portion of the tap-in-fee.
THIRD: The Authority hereby amends Resolution No. 1-96
to include the tap-in-fee provided herein.
FOURTH: The Authority hereby establishes $2,868.00 as
the tap-in-fee consisting of $1,588.00 per EDU for the collection portion and
$1,280.00 per EDU for the capacity portion.
FIFTH: All other provisions of Resolution Nos., 1-96,
13-97, and 14-97 are hereby incorporated by reference with the same force and
effect as though fully set forth herein at length.
SIXTH: This Resolution shall take effect on July 1,
2005.
