RESOLUTION 70-02

 

A RESOLUTION OF THE WEST MIFFLIN SANITARY SEWER MUNICIPAL AUTHORITY, ALLEGHENY COUNTY, PENNSYLVANIA AUTHORIZING AN EASEMENT AGREEMENT WITH CSX TRANSPORTATION, INC. AND PROVIDING FOR APPROPRIATE PAYMENTS.

 

          WHEREAS, it is necessary for the Authority to enter into an Easement Agreement with other members of the Streets Run Interceptor Group and CSX Transportation for the purpose of constructing a sanitary sewer line; and

          WHEREAS, the Authority has been presented with a Pipeline Longitude and Occupancy Agreement (Easement Agreement) providing for a License Agreement between CSX Transportation, Inc. and the Borough of Baldwin, Borough of Brentwood, Borough of Whitehall and West Mifflin Sanitary Sewer Municipal Authority, which are collectively referred to as the Streets Run Sewer Shed Municipal Members.

          NOW THEREFORE, be it resolved and it is hereby resolved as follows:

          1.          The Board hereby approves a Pipeline Longitude and Occupancy Agreement known as CSX-042691 by and between CSX Transportation, Inc. and Borough of Baldwin, Borough of Brentwood, Borough of Whitehall and West Mifflin Sanitary Sewer Municipal Authority.

          2.          The payment of an amount not to exceed $22,947.50 for reimbursement to the Borough of Baldwin based upon said agreement is hereby authorized said payment representing a twenty-five (25%) percent share of the total cost not to exceed $91,790.  It is further resolved that said twenty-five (25%) percent shall be paid out of the 1998 Bond Issue.

          3.          It is hereby further resolved that the balance of said amount shall be paid by the Borough of Baldwin, Borough of Brentwood and Borough of Whitehall.

          4.          The proper officers are hereby authorized, empowered and directed to execute said agreement on behalf of the Authority and to do all acts necessary to effectuate said agreement.
