JOINT RESOLUTION OF THE

BOROUGH OF BALDWIN

BOROUGH OF WHITEHALL

BOROUGH OF BRENTWOOD

WEST MIFFLIN SANITARY SEWER MUNICIPAL AUTHORITY

PITTSBURGH WATER AND SEWER AUTHORITY

 

A JOINT RESOLUTION OF THE BOROUGHS OF BALDWIN, WHITEHALL AND BRENTWOOD, WEST MIFFLIN SANITARY SEWER MUNICIPAL AUTHORITY AND THE PITTSBURGH WATER AND SEWER AUTHORITY APPLYING FOR GRANT ASSISTANCE UNDER THE THREE RIVERS WET WEATHER PROGRAM AND A COMMITMENT TO THE STREET RUN INTERCEPTOR LINE AND THE REPAIRS AND RESTORATION OF THE SANITARY SEWER MANHOLES.  THE PARTICIPATING BODIES CONTINUE THE EXECUTION OF EXISTING COOPERATIVE AGREEMENTS BY THE IMPLEMENTATION OF THEIR RESPECTIVE CORRECTIVE ACTION PLANS AS PREVIOUSLY ADOPTED BY THE SAID MUNICIPALITIES.

 

            WHEREAS, Baldwin Borough, Whitehall Borough and Brentwood Borough, the West Mifflin Sanitary Sewer Municipal Authority, and the Pittsburgh Water and Sewer Authority are tributary to the Streets Run Interceptor; and

            WHEREAS, all of the above named municipal entities have performed investigative efforts and have agreed to apply under the Three Rivers Wet

Weather Program for grant monies for the repairs and restoration of the sanitary sewer manholes.

            WHEREAS, valid legal agreements exist concerning the cost distribution to each community in the Streets Run Watershed, including the Borough of Baldwin, for the maintenance and repair of the existing Streets Run Interceptor; and

            WHEREAS, the share of the cost for maintenance and repair of the Streets Run Interceptor for each of the municipalities and/or authorities involved has been determined from existing inter-municipal agreements to be as follows:

            WHEREAS, each of the contributing municipal entities has passed this Resolution approving their respective participation under the Three Rivers Wet Weather Program and in the work to be done in connection with the said Streets Run Interceptor and Streets Run Watershed, and has agreed to pay their respective share for the work as those percentages set forth.

            NOW, THEREFORE, be it jointly resolved by the Councils of the Boroughs of Baldwin, Whitehall, Brentwood, West Mifflin, and the Boards of the West Mifflin Sanitary Sewer Municipal Authority and the Pittsburgh Water and Sewer Authority and it is hereby resolved by the Authority of the same as follows:

1.         The Boroughs of Baldwin, Whitehall and Brentwood, and the West Mifflin Sanitary Sewer Municipal Authority reaffirm their joint and several commitments for investigation, identification of problems and performance of work on the Streets Run Trunk Line and Interceptor, and toward that end jointly resolve to make application under the Three Rivers Wet Weather Program for grant monies for the repairs and restoration of the sanitary sewer manholes under he hospice and assistance of such grant program.

 

2.         The Boroughs of Baldwin, Whitehall and Brentwood, and the West Mifflin Sanitary Sewer Municipal Authority and the Pittsburgh Water and Sewer Authority hereby acknowledge the existing agreements concerning the investigative and maintenance work repair of the Streets Run Trunk and Interceptor and agree to bear their respective appropriate share of the costs of this said project not covered by grant monies received through the Three Rivers Wet Weather Program, subject to the review of any plan specifications and costs and verifications of the participation of the involved municipalities.

 

3.         The Borough of Baldwin, Whitehall and Brentwood and the West Mifflin Sanitary Sewer Municipal Authority agree and resolve to continue with their respective Corrective Action Plans as previously laid out and adopted by each respective municipality and/ or authority.

 

            RESOLVED, this 5th day of January 2000.
