RESOLUTION NO. 46-99
A RESOLUTION
OF THE WEST MIFFLIN SANITARY SEWER MUNICIPAL AUTHORITY, COUNTY OF ALLEGHENY,
COMMONWEALTH OF PENNSYLVANIA, APPROVING SETTLEMENT AGREEMENT WITH 51 PARK
PROPERTIES, NOW KNOWN AS NEW COLONY LLP, FOR PAYMENT OF ARREARAGES, ESTABLISHMENT
OF FLAT-FEE PAYMENTS, CONSTRUCTION OF NEW WATER LINES, AND EASEMENTS.
WHEREAS, the West Mifflin Sanitary
Sewer Municipal Authority initiated a lawsuit filed at G.D. 97-11488 for the
collection of delinquent sewage bills; and
WHEREAS, New Colony filed a Counterclaim; and
WHEREAS, the parties have determined that it is in
their mutual best interests to settle all claims and contentions.
NOW, THEREFORE, BE IT RESOLVED AND IT IS
HEREBY RESOLVED as follows:
1. The West Mifflin Sanitary
Sewer Municipal Authority hereby approves the terms and conditions contained
in the Settlement Agreement attached hereto in its entirety.
2. Said Settlement Agreement
is a full and final resolution of the outstanding litigation.
3. The lump-sum payment of
$100,000.00 will be paid directly to the Authority for deposit in its General
Fund.
RESOLVED, this 5th day of August 1999.
