A RESOLUTION
OF THE WEST MIFFLIN SANITARY SEWER MUNICIPAL AUTHORITY APPROVING THE AUTHORITY’S
PARTICIPATION IN A THREE RIVERS WET WEATHER DEMONSTRATION PROGRAM GRANT IN
CONNECTION WITH THE STREETS RUN WATERSHED AND STREETS RUN INTERCEPTOR.
WHEREAS, a portion of the sewer service of the West Mifflin Sanitary Sewer
Municipal Authority is a tributary to the Streets Run interceptor; and
WHEREAS, other municipal entities (i.e. the Borough of Baldwin, the Borough
of Brentwood, the Borough of Whitehall and Pittsburgh Water and Sewer Authority)
are also a tributary to the Streets Run interceptor; and
WHEREAS, the Pennsylvania Department of Environmental Protection (DEP)
has stated that investigations and repair must be made in the Streets Run
Watershed before DEP will allocate sewage taps to any communities in the Streets
Run Watershed; and
WHEREAS, all of the above named municipal entities have performed investigative
efforts in their respective municipal boundaries without fully demonstrating
that the Streets Run Watershed is in an acceptable condition to receive sewage
taps; and
WHEREAS, valid legal agreements exists concerning the cost distribution
to each community including the Borough of West Mifflin for the maintenance
and repair of the existing Streets Run interceptor; and
WHEREAS, the West Mifflin Sanitary Sewer Municipal Authority is the Assignee
of the responsibility of the Borough of West Mifflin under said agreements;
and
WHEREAS, the West Mifflin Sanitary Sewer Municipal Authority share of
the cost for maintenance and repair have been determined from existing inter-municipal
agreements to be as follows:

NOW, THEREFORE, be it resolved and it is hereby resolved as follows:
1. The West Mifflin Sanitary
Sewer Municipal Authority hereby agrees to pay the above noted percentage
of costs for the investigation of the Streets Run interceptor in cooperation
with the Boroughs of Baldwin, Brentwood, Whitehall and the Pittsburgh Water
and Sewer Authority.
2. The West Mifflin Sanitary
Sewer Municipal Authority hereby acknowledges the existing agreements and
agrees to bear its appropriate share of costs of the operation and maintenance
of the Streets Run interceptor subject to review of any plans, specification
and costs and verification of the participation of the involved municipalities.
3. The appropriate officers
of the Authority are hereby authorized, empowered and directed to execute
all agreements and do all other things necessary to effectuate the purpose
of this Resolution.
