RESOLUTION NO.  39-99

 

A RESOLUTION OF THE BOARD OF DIRECTORS OF THE WEST MIFFLIN SANITARY SEWER MUNICIPAL AUTHORITY, ALLEGHENY COUNTY, PENNSYLVANIA, APPROVING THE FIRST AMENDMENT TO THE CONSENT ORDER AND AGREEMENT WITH THE COMMONWEALTH OF PENNSYLVANIA, DEPARTMENT OF ENVIRONMENTAL PROTECTION (PADEP), AND AUTHORIZING PROPER OFFICERS TO EXECUTE THE CONSENT ORDER AND AGREEMENT ON BEHALF OF THE AUTHORITY.

 

WHEREAS, the Borough of West Mifflin and the PADEP entered into a Consent Order and Agreement on September 21, 1993, relative to the Thompson Run Sewage Treatment Plant and the New England Sewage Treatment Plant; and

 

WHEREAS, the West Muffin Sanitary Sewer Municipal Authority (The Authority) was incorporated on May 9, 1996; and

 

WHEREAS, by Agreement dated July 10, 1996, the Authority assumed all responsibilities and duties of the Borough of West Mifflin with respect to the ownership, operation and maintenance of the Municipal Sanitary Sewage Collection and Treatment System; and

 

WHEREAS, it is the desire of the Authority to assume all responsibilities of the Consent Order and Agreement and it is the desire of the Borough to have all responsibilities and duties of the Consent Order and Agreement assigned to the Authority.

 

NOW THEREFORE, be it resolved and it is hereby resolved as follows:

 

1.             The Authority hereby approves the First Amendment to the Consent Order and Agreement and acknowledges that it is an Order of the PADEP authorized and issued pursuant to the Pennsylvania Clean Streams Law, the Pennsylvania Sewage Facilities Act and the applicable sections of the Administrative Code.

 

2.             The proper officers of the Authority are hereby authorized with power and then directed to execute the said First Amendment to Consent Order and Agreement on behalf of the Authority and to transmit same to the Borough of West Mifflin for its concurrence.

 

3.             The actions of the officers in executing the documents described herein are hereby ratified and approved.
