RESOLUTION NO. 34-98

RESOLUTION OF THE WEST MIFFLIN SANITARY SEWER MUNICIPAL AUTHORITY, ALLEGHENY COUNTY, PENNSYLVANIA, AMENDING RESOLUTION NO. 23-97.

WHEREAS, the West Mifflin Sanitary Sewer Municipal Authority is authorized, pursuant to Resolution 23-97, to send notices for the demand of payment of delinquent monies owed for the use of the sanitary sewers and said notice was for delinquencies owed both to the Borough of West Mifflin as well as the Authority; and

WHEREAS, the delinquent charges owed to the Borough of West Mifflin remain the responsibility of the Borough of West Mifflin;

NOW, THEREFORE, be it resolved it is hereby resolved as follows:

SECTION 1. Resolution 23-97 is amended to remove the delinquent charges owed to the Borough of West Mifflin from the demand notice for payment of delinquencies owed to the Authority, as delinquent charges owed to the Borough of West Mifflin remain the responsibility of the Borough.

SECTION 2. If any sentence, clause or section or any part of this Resolution is for any reason found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses or sections or parts of this Resolution. It is hereby declared as the intent of the Authority that this would have been enacted had such unconstitutional, illegal or invalid sentence, clause or section or part thereof not be included herein.

SECTION 3. Any resolution or parts of resolutions which are contrary to or conflict with the provisions of this Resolution are hereby repealed to the extent necessary to give this Resolution full force and effect.
