RESOLUTION
NO. 3-96/98
RESOLUTION OF
THE WEST MIFFLIN SANITARY SEWER MUNICIPAL AUTHORITY, ALLEGHENY COUNTY, PENNSYLVANIA,
AMENDING RESOLUTION NO. 3-96 BY CLARIFIYING THE RATE CLASSIFICATIONS FOR RESIDENTIAL
AND COMMERCIAL/INDUSTRIAL THROUGH THE ADDITION OF SPECIFIC DEFINITIONS.
WHEREAS, the West Mifflin Sanitary Sewer Municipal Authority, on July
3, 1996, adopted a resolution imposing rates and charges effective on the
date the Authority acquired the sewage treatment system from the Borough of
West Mifflin; and
WHEREAS, the Authority wishes to clarify, by specific definition, the
rate classifications for residential and commercial/industrial in order that
Authority customers continue to have rate classifications as applied by the
Pennsylvania American Water Company, and so that the rate classifications
are specific in their definitions.
NOW, THEREFORE, BE IT RESOLVED AND IT IS HEREBY RESOLVED as follows:
SECTION 1. Residential rates are
those rates applied to single premises residences or to multiple premises
residences, including houses or apartment buildings, where each unit or premises
is served through a separate meter.
SECTION 2. Commercial/Industrial
rates are applied as follows:
a)
To multiple premises residences served through a single meter or a battery
of meters;
b)
To all private institutions and organizations;
c)
To manufacturing or processing establishments;
d)
To residences such as apartment and boarding houses, hotels, offices,
office buildings, retail and wholesale commercial establishments, laundries,
churches, private schools and colleges, private hospitals, private cemeteries,
etc.
e)
To manufacturing and industrial customers such as steel works, automobile
manufacturers, breweries, public utilities (other than sales to other water
utilities), stockyards, packing houses, grain elevators, bottling works.
SECTION 3. This Resolution is
not meant to change any of the rates or rate classifications as previously
enacted by the Authority but is to expressly clarify the rate classifications
by adding definitions.
SECTION 4. If any sentence, clause
or section or any part of this Resolution is for any reason found to be unconstitutional,
illegal or invalid, such unconstitutionality, illegality or invalidity shall
not affect or impair any of the remaining provisions, sentences, clauses or
sections or parts of this Resolution. It is hereby declared as the intent of the
Authority that this would have been enacted had such unconstitutional, illegal
or invalid sentence, clause or section or part thereof not be included herein.
SECTION 5. Any resolution or parts
of resolutions which are contrary to or conflict with the provisions of this
Resolution are hereby repealed to the extent necessary to give this Resolution
full force and effect.
SECTION 6. This Resolution is
intended to be read in pari materia with Resolution No. 3-96 and, therefore,
is retroactive and effective as of July 3, 1996.
