RESOLUTION NUMBER 26-97

A RESOLUTION OF THE WEST MIFFLIN SANITARY SEWER MUNICIPAL AUTHORITY AUTHORIZING AN AGREEMENT TRANSFERRING RESPONSIBILITY UNDER THE CONSENT ORDER AND AGREEMENT FROM THE BOROUGH OF WEST MIFFLIN TO THE AUTHORITY.

WHEREAS, the Borough of West Mifflin and the Pennsylvania Department of environmental Protection (PaDEP) are parties to a Consent Order and Agreement with respect to the operation of the sewage system in the Borough

WHEREAS, the Authority has assumed all responsibilities and duties of the Borough with respect to the ownership, operation, and maintenance of the Municipal Sanitary sewage collection and treatment system, and

WHEREAS, it is necessary to have the responsibilities and obligations of the Borough transferred to the Authority with the consent of PaDEP

NOW, THEREFORE, BE IT RESOLVED AND IT IS HEREBY RESOLVED as follows:

1. The Board of Directors hereby authorizes and approves a first amendment to the Consent Order and Agreement between the Borough of West Mifflin, the Authority, and PaDEP relative to the assignment of the Consent Order and Agreement to the Authority.

2. The proper officers and solicitors authorize the power and are directed to execute said Agreement upon completion and to do all other acts necessary to effectuate the end of this Resolution.
