RESOLUTION NO. 15-97
A RESOLUTION OF THE BOARD OF DIRECTORS OF THE WEST MIFFLIN SANITARY SEWER MUNICIPAL AUTHORITY RELATIVE TO THE ESTABLISHMENT AND MAINTENANCE OF EMPLOYEES PENSION, ANNUITY, INSURANCE AND BENEFIT FUND OR FUNDS. TO ESTABLISH AND MAINTAIN PROVISIONA OF THE PENSION PLAN OR PROGRAM APPLICABLE TO THE EMPLOYEES OF SAID AUTHORITY AND TO SET FORTH IN ITS ENTIRETY SUCH PENSION PLAN OR PROGRAM.
BE IT RESOLVED AND ADOPTED by the Board of Directors of the West Mifflin Sanitary Sewer Municipal Authority (“Authority”) and it is HEREBY RESOLVED AND ADOPTED BY THE authority of the same:
The West Mifflin Sanitary Sewer Municipal Authority Employees’ Pension plan (“plan) which is established as a spin-off plan from the Authority of West Mifflin Non-Uniformed Employees’ Pension Plan (“Prior Plan”) which was established as of December 1, 1963, and amended thereafter from time to time, is hereby established as a follow on plan for the continuing benefit of those employees who are transferred to the Authority as hereinafter set forth.
Any Resolutions or parts thereof, which conflict with the provisions of this Resolution shall be, and the same are hereby repealed so far as they shall affect this Resolution. Such repeal shall not affect any act done or any right or liability accrued under any such Resolution which shall be hereunder repealed or superseded and all such rights or liabilities shall continue and may be enforced in the same manner as if such repeal or supersession had not been made but only to the extent otherwise permitted under the laws of the commonwealth of Pennsylvania.
EFFECTIVE August 21, 1996, the Plan, shall be set forth as follows:
