RESOLUTION NO. 1-96

WEST MIFFLTN SANITARY SEWER MUNICIPAL AUTHORITY

RESOLUTION ADOPTING THE PROVISIONS OF BOROUGH ORDINANCE 1006, AN ORDINANCE OF THE BOROUGH OF WEST MIFFLIN, ALLEGHENY COUNTY, COMMONWEALTH OF PENNSYLVANIA, PROVIDING FOR AND AUTHORIZING AND DIRECTING THE PAYMENT OF A CONNECTION FEE (TAP-IN-FEE) FROM THE OWNERS OF PROPERTY OF VARIOUS SEWER DISTRICTS SERVED BY THE SANITARY SEWAGE TREATMENT WORKS IN THE VARIOUS SEWAGE DISTRICTS OF THE BOROUGH OF WEST MIFFLIN PROVIDING FOR THE COLLECTION THEREOF AND FILING OF LIENS THEREFOR; AND PRESCRIBING PENALTIES FOR A VIOLATION.

WHEREAS, the West Mifflin Sanitary Sewer Municipal Authority (‘Authority’) shall acquire the sewer system and sewage treatment facilities owned by the Borough of West Mifflin on or about August 21, 1996; and

WHEREAS, the Borough of West Mifflin has in force Ordinance 1006 which, inter alia authorizes and directs the payment of a connection and/or tap-in fee from the owners of property of various sewer districts served by the Sanitary Sewer Treatment Works in the various sewage districts of the service area of the Authority.

NOW, THEREFORE, BE IT RESOLVED AND IT IS HEREBY RESOLVED as follows:

1. The Authority hereby adopts and approves Ordinance 1006 with the same force and effect as though set forth herein at length.

2. The Authority shall have all of the rights set forth in said Ordinance 1006 which are reserved to the Borough of West Mifflin on and after the date the system is transferred to the Authority. The proper officers of the Authority are hereby authorized to execute the full text of the Resolution with the provisions of Ordinance 1006 set forth at length upon preparation.
