ORDINANCE NO. 990
AN ORDINANCE OF THE
BOROUGH OF
NOW,
THEREFORE, BE IT ORDAINED AND ENACTED by Council of the Borough of West
Mifflin, at meeting assembled, and it is hereby ORDAINED and ENACTED by
authority of the same as follows:
SECTION 1. That Ordinance
No. 907 shall be amended by adding additional rules and regulations to those
already existing in Ordinance No. 907 as hereinafter set forth.
SECTION 2. That Council of the Borough of West Mifflin
is hereby authorized and empowered to undertake within the Borough the control
and methods of holding tank use, sewage disposal and sewage collection and
transportation thereof.
SECTION 3. FIXING
CHARGES. That Council of the Borough of West Mifflin shall have the right
and power to fix, alter, charge and collect rates, assessments and other
charges in the area served by its facilities at reasonable and uniform rules as
authorized by applicable law.
SECTION 4. The following rules and regulations shall be
the exclusive right and privilege of the Council of the Borough of West
Mifflin:
A. The
collection and transportation of all sewage from any improved property
utilizing a holding tank shall be done solely by or under the direction and
control of the Council of the Borough of West Mifflin, and the designated
agent, Zoning Officer of the Borough of West Miff un, and the disposal thereof
shall be made only at such site or sites as may be approved by the Department
of Environmental Resources of the Commonwealth of Pennsylvania.
B.
The
Council of the Borough of West Mifflin will receive, review and retain pumping
receipts from permitted holding
tanks.
C. That
Council of the Borough of West Mifflin will complete and retain annual
inspection reports for each permitted tank.
SECTION 5. ABATEMENT OF NUISANCES.
In addition to any other remedies provided in this Ordinance, any violation of
this Ordinance shall constitute a nuisance and shall be abated by the Borough
of West Mifflin or by Council of the Borough of West Mifflin, by either seeking
mitigation of the nuisance or Mifflin this 17th day of March, 1992 by majority
vote of the Council of the Borough of West Mifflin.
